Warranty

  1. The consumer and/or business customer can only derive rights from a warranty if he proves that he has purchased the goods from the entrepreneur. This proof can be provided by the consumer and/or business customer by submitting the relevant purchase agreement or invoice to the entrepreneur.
  2. Claims by consumers and/or business customers under a warranty are not transferable to third parties.
  3. The entrepreneur guarantees the soundness and usability of the goods delivered by it for one month or otherwise in consultation after the purchase. The consumer and/or business customer therefore has the right, in the event of proven unsoundness, to offer the delivered item to the entrepreneur for replacement in accordance with the applicable General Terms and Conditions for a period of one month. This proof can be provided by the consumer and/or business customer by submitting the relevant “work order” or invoice to the entrepreneur.
  4. The entrepreneur undertakes, in the event that point 3 of these Guarantee Conditions and the General Terms and Conditions are met, to replace the item offered as a replacement within a reasonable period of time with comparable goods, unless the entrepreneur is unable to do so, in which case the entrepreneur will refund the relevant purchase amount.
  5. The goods received by the consumer and/or business customer after repair/replacement are again eligible for the basic warranty (or until the end date of the original additional warranty).
  6. The consumer and/or business customer cannot claim a warranty:
    1. if the consumer and/or business customer has provided incorrect or insufficient information regarding the brand and type designation of the purchased item and/or the vehicle for which the part is intended;
    2. The warranty obligation shall lapse if the consumer and/or business customer fails to meet or has failed to meet their payment obligations punctually. The consumer and/or business customer shall not be entitled to refuse payment on the grounds that their warranty obligations have not yet been fulfilled or have not been fulfilled in full.
  7. The following are excluded from the warranty:
    1. Defects in materials or parts that have been specified or made available by the consumer and/or business customer;
    2. Defects in built-in electronic components;
    3. Defects in fuel systems such as tanks and additional components that have not been flushed or replaced. The warranty also does not cover repairs to engine defects that have arisen as a result of the use of fuels for which the engine is not suitable (according to the manufacturer's specifications regarding prescribed fuel use) or for which the engine has not been made suitable.
    4. Engine damage caused by failure and/or incorrect use of the electronic components and/or electronic peripherals is also excluded from the warranty, as are defects that are not material and/or construction defects (such as defects resulting from normal wear and tear, internal and external contamination, rust and paint damage, transport, freezing, overheating, overloading and/or dropping the product).
    5. If parts other than those specified by the manufacturer were used during installation;
    6. If non-original parts were used during installation;
    7. If the purchased item has been installed in a vehicle for which it was not originally intended;
    8. If the purchased item is installed in a sports car or a tuned vehicle;
    9. Defects arising as a result of: intent, failure to perform normal or prescribed maintenance, incorrect installation/connection/modifications carried out by third parties, poor handling, incorrect (or other than the intended normal) use are also excluded from the warranty;
    10. Nor is there any entitlement to warranty in respect of defects arising as a result of accessories belonging to the item but not inspected, or in respect of defects and damage arising from the participation of a vehicle in competitions or speed trials.
  8. The warranty on engines and/or gearboxes only applies if it can be demonstrated that oil and/or toothed belts or filters have been replaced.
  9. No warranty is given on work and/or parts relating to installation.
  10. If any other provision of the applicable General Terms and Conditions or Warranty Conditions has been violated, insofar as these are prescribed on pain of forfeiture of rights.
  11. The consumer and/or business customer cannot derive any right to compensation of any kind from a warranty, except insofar as the entrepreneur is obliged to do so by law or the applicable General Terms and Conditions.
  12. The entrepreneur has the right to deviate from these warranty conditions if, prior to the conclusion of the purchase agreement, the consumer and/or business customer has been expressly informed of this and the deviating provisions have been laid down in writing between the entrepreneur and the buyer.
